Visa cancellations are at the discretion of the Department of Home Affairs.
Immediate Cancellation at the Airport
Visitor visas can be cancelled on the spot if:
- The immigration officer questions the genuineness of the visit.
- The visa holder is caught with quarantine-restricted materials.
Should You Request a Visa Cancellation?
We do not recommend requesting cancellation of your visa because you have applied for another visa. If your visa is cancelled, all other visas (including bridging visas) may also be cancelled, affecting your legal stay in Australia.

What Happens If Your Visa is Cancelled?
If your visa is cancelled:
- All other visas you hold, including bridging visas and those of family members, may be cancelled.
- You may be barred from applying for certain visas or prevented from staying in Australia.
- If your visa is cancelled on character grounds, the only visa you can apply for is a Protection visa.
- If removed from Australia on character grounds, future visa applications may be affected due to failing the character test.
Steps After Receiving a NOIC
- Seek legal advice immediately upon receiving the notice.
- Submit a response explaining why your visa should not be cancelled.
- If the Department accepts your response, you retain your visa.
- If the Department rejects your response or you do not respond, you will receive a formal Notice of Cancellation.
- If your visa is cancelled, you will be given a deadline to leave Australia or you may be placed in immigration detention.
- If not cancelled but warned, future offenses could still lead to visa cancellation.
Appealing a Visa Cancellation
If your visa is cancelled, you may:
- Appeal to the Administrative Appeals Tribunal (AAT).
- Take the matter to the Federal Circuit Court if necessary.
