- If outside Australia:
- Partner Temporary Visa (Subclass 309) – Allows entry and stay in Australia with a partner.

- Prospective Marriage Visa (Subclass 300):
- Designed for individuals intending to marry an Australian citizen, permanent resident, or eligible New Zealand citizen before applying for a Partner Visa.

Additional Eligibility for Partner Visa in Australia
Applicants with a previous visa refusal or cancellation may still be eligible under specific conditions, such as:
- No previous partner visa refusals after the last entry into Australia.
- No visa cancellations on character grounds under section 501.
- Submission of Form 40SP Sponsorship for a Partner, signed by an eligible sponsor.
- Two statutory declarations from eligible Australians confirming the relationship, submitted within six weeks of application.
